§ 1 Scope of Application


The following terms and conditions apply to any consignment of goods from Musikboutique Wiedemann to customers (as defined in §13 German Civil Code (BGB)).


§ 2 Contracting Parties


The sales contract is effected with: Musikboutique Wiedemann, Propriertor: Rainer Wiedemann, Greiselbach 13b, D-91634 Wilburgstetten, Germany. Professional Register: Handwerkskammer für Mittelfranken, Nuremberg/Germany No.76407. § 3 Offer and Conclusion of Contract


§ 3.1 The depiction of products on our website is not a legally binding offer but an invitation to place an order. Errors excepted.


§ 3.2 By clicking on the "Confirm order" button at the end of the ordering process you place a legally binding order for the articles contained in your shopping cart. The sales contract is concluded when we accept your offer by sending you the ordered items.


§ 4 Right of Revocation

Customers may return received items without giving reasons within a period of two weeks by sending them back. This two weeks' period begins after the receipt of their order. In order to exercise this right, customer must notify us

of their intention to revoke this sales agreement by means of a by means of a distinct declaration (i.e. letter, fax oder email message). For this purpose customers may use our Return form http://www.musikboutique-wiedemann.de/return. In this case, we will send them a receipt as soon as possible.

Please note that we will not accept any returned orders without a prior declaration of revocation, nor will we accept any freight forward shipments sent to our address.

Consequences of Revoking your Order

When you exercise your right of revocation, we shall refund all payments we have received from you, including shipment costs (as long as you have chosen our preferred standard, most inexpensive way of transportation) in due time and within 14 days at the most, beginning with the day when your declaration of revocation has been confirmed by us. For refunding your money we shall choose the same method of payment you have chosen, unless any different agreements have been explicitly made. No extra costs will be charged for this refund. We retain the right to deny refunding your payments until we have received the ordered items back, or until you have shown us unambiguous proof that you have sent them back to us, whatever occurs first. You must return the purchased items in due time and within 14 days at the most, beginning with the day when your declaration of revocation has been confirmed by us. You are to bear the immediate costs of returning the purchased items. You are liable for any loss in value of the returned items only, if this loss in value has occured due to inappropriate handling of the returned items on your part which is/was not required for checking the quality, features and functionality of the ordered/returned items.

§ 4.2 A right of return does not exist in case of goods which have been manufactured according to customer specifications or which are customized, or in case of audio and/or video recordings or software if the respective data carriers have been unsealed.

§ 4.3 Please avoid damage and contamination. If possible, please send the goods in their original packing complete with any accessories and wrapping parts. Where required, please use a secondary packaging. If you no longer have the original packing, please make sure that a suitable packing avoids any damage in transit.

§ 4.4 Please send returnable goods as adequately insured and registered parcels and keep the receipt. If you wish we'll refund postal charges in advance.


§ 4.5 Before returning any goods please inform us by calling +49 (0)9853 385 270.


§ 5 Prices and Shipping Costs


§ 5.1 Prices given on the product pages include VAT and other price components.


§ 5.2 In addition to the prices given on product pages we charge shipping costs per order for the delivery. In the course of the ordering procedure these shipping costs will once more be pointed out to you. If your order exceeds the delivery company's maximum weight limits, you will receive several parcels. (For more information on Shipping and Handling costs see here) For orders over €50, shipping and handling is free wihtin Germany.


§ 5.3 In case of COD, the delivery company charges an extra fee of €4,95. Apart from this, no further taxes or costs will arise. COD payment is available only for Germany.


§ 5.4 When picking up your order in one of our stores, no additional shipping/handling costs will be charged. In this case §5.2 is suspended.


§ 6 Delivery


§ 6.1 Our preferred delivery company for Austria, Belgium, Bulgaria, Canada, Cyprus, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungaria, Ireland, Italy, Latvia, Lithuania, Luxemburg, Malta, Mexico, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Sweden, Switzerland, the U.K., and the USA is DHL.


§ 6.2 The delivery time os approx. 3-5 days. Exceptions are mentioned explicitly on the respective product pages.


§ 7 Payment


§ 7.1 We accept payments in cash, in advance (bank transfer), on delivery (COD), via PayPal and via iclear.


§ 7.2 If you decide to pay in advance, our bank details will be displayed on the confirmation and the goods will be shipped on receipt of payment.


§ 7.3 The right to offset any claims shall be granted only if claims on your part have been legally confirmed or are uncontradicted or have been acknowledged by us in writing.


§ 7.4 Retention rights may only be exerted on your part if such claims results from the same contractual relationship.


§ 8 Reservation of Proprietary Rights


The delivered goods are considered our property until payment has been made in full.


§ 9 Warranty


Statutory warranties as described in the German Civil Code (BGB) shall apply. The statutory 2-year warranty period begins with the time of delivery. In case of defects customers may legally demand supplementary performance (at their option: removal of the defect, or supply of a thing free from defects) and - provided the legal precoditions are given - exert their legal rights concerning warranty claims for reductions in the purchase price, or cancellation of the sales contract, and/or claim compensation.
